Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Invoia, an e-invoicing platform operated by Evidentia B.V. ("Evidentia", "we", "us"). By creating an account or using Invoia you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and legally authorised to bind your business to these Terms. Invoia is intended for business users (B2B); consumer use is not supported.

3. The service

Invoia provides:

  • Generation of EU-compliant Peppol BIS 3.0 / UBL 2.1 e-invoices.
  • Sending and receiving invoices via the Peppol network through our access point provider.
  • 7-year invoice archive with audit trail and export.
  • An API for programmatic integration.

We may modify, suspend, or discontinue features with reasonable notice (30 days for material changes that affect paid subscribers).

4. Accounts

You are responsible for keeping your credentials secure. Notify us immediately of any unauthorised access. Each account corresponds to one legal entity. You may not share accounts or resell access without written permission.

5. Acceptable use

You agree not to:

  • Use Invoia to send fraudulent, forged, or fictitious invoices.
  • Circumvent rate limits, security controls, or access restrictions.
  • Reverse-engineer the service or use it to build a competing product without permission.
  • Violate applicable law, including VAT regulations and Peppol network rules.

6. Data and privacy

Your use of Invoia is also governed by our Privacy Policy. Invoice data you submit is processed to deliver the service and retained for legal compliance purposes as described therein.

7. Fees and payment

Paid plans are billed monthly in advance via Mollie. Prices are in EUR and exclude applicable VAT. Unpaid invoices may result in service suspension after 14 days. No refunds are issued for partial months, except where required by applicable law.

8. Liability

To the maximum extent permitted by law, Evidentia's aggregate liability for any claim arising from these Terms shall not exceed the fees you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential losses.

Invoia does not constitute tax or legal advice. You remain responsible for the accuracy and completeness of invoice data you submit and for compliance with applicable VAT and e-invoicing obligations.

9. Termination

You may cancel your account at any time via account settings. We may terminate accounts that violate these Terms. Upon termination, you have 30 days to export your data before it is scheduled for deletion (subject to mandatory retention obligations).

10. Governing law

These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, unless mandatory consumer law provides otherwise.

11. Changes

We may update these Terms. Material changes will be communicated at least 30 days in advance. Continued use after the effective date constitutes acceptance.
